Indigenous Territories and EUDR: How Orbify Supports Due Diligence

The EUDR includes requirements related to land rights and Indigenous peoples, but these obligations cannot be assessed through automated deforestation analysis alone. Orbify therefore treats Indigenous territories as a separate informational layer, rather than part of the automated compliance score.

How Indigenous Territories Are Handled

Orbify identifies and displays any potential overlap or interaction between a plot and mapped Indigenous territories. This information is provided to support user due diligence, not to determine compliance automatically.

Overlap with Indigenous territories:

  • Does not trigger a non-compliant status

  • Does not affect the deforestation compliance score

  • Does indicate a need for further legal and ethical assessment by the user

User Responsibilities

Because land tenure and Indigenous rights are highly context-specific, Orbify places responsibility on the user to:

  • Assess applicable national and local legal requirements

  • Produce relevant documentation, such as Free, Prior, and Informed Consent (FPIC)

  • Include this evidence in their EUDR due diligence submission

Orbify’s role is to ensure that potential risks are visible and cannot be overlooked, while recognising that final determinations require legal and contextual judgement.
